6207 Lawyering Skills and Strategies -
Course Outline: Lawyering Skills and Strategies II will focus on legal writing in litigation and transactional contexts and the skills and strategic planning lawyers must possess to succeed within actual lawyering experiences. The curriculum will be problem – based, using fact-pattern simulations to enable students to work through actual practice skills and strategies and ethical issues. Training in essential lawyering skills such as oral communication, legal writing, research, and analysis will be embedded within fact pattern simulations involving typical litigation and transactional issues that students will work through to develop lawyering skills and problem-solving strategies. Students at times will be assigned to represent opposing sides of the problem.

SPRING 2015 ~ FIRST DAY ASSIGNMENT
Research the following question using whichever service you prefer: Lexis, Westlaw or Bloomberg Law.
At the time Fred Smith died, he and his wife, Ginger, had a foster child, Dorothy, living with them. Fred and Ginger planned to adopt Dorothy, but had not yet done so at the time of Fred’s death. Related to Fred’s death, Ginger has filed suit under the Texas wrongful death statute. The wrongful death statute provides, in pertinent part, “An action to recover damages as provided by this subchapter is for the exclusive benefit of the surviving spouse, children, and parents of the deceased.” Tex. Civ. Prac. & Rem. Code Ann. § 71.004 (West 2013).
Is Dorothy a proper party to the wrongful death action?
Please carefully keep track of your research path. Not only will we discuss this in our first class; you will turn it in so that I can follow your research path and give you commentary on how you might improve your research efficiency.
