Course Outline: Administrative agencies execute laws affecting almost every aspect of modern legal practice and daily life — including regulating labor-management relations, patents, telecommunications, workplace health and safety, financial markets, national security, immigration, and much more. This course covers the principles and procedures common to all federal agencies, derived in large part from the U.S. Constitution and the Administrative Procedure Act. Topics include the sources of agency authority, the constitutional and statutory framework that governs agency adjudication and rulemaking, the role of agencies in interpreting statutes and regulations, and judicial review of agency actions.

Course Notes: (Face-to-Face)  The UH registration system instruction mode for this course is listed in parenthesis. For this instruction mode, instructors and students are expected to normally be physically present in the classroom. If the course has a final examination, it will be in a classroom requiring your physical presence. Other assessment, such as a mid term exam, may also be in a classroom. Whether this instructor will offer “remote presence” (starting a zoom meeting from the podium computer to enable student remote access on an occasional basis) for part or all of the semester is not known, but students should not rely on an expectation that remote presence will be available.

Brandon Duke is an attorney in the Houston office of Winston & Strawn LLP where he focuses on antitrust litigation and complex commercial litigation for clients in the oil and gas industries. He practices regularly in state and federal trial and appellate courts and before federal administrative agencies. He received his B.A. in History and Philosophy from Texas A&M University and his J.D. from Columbia Law School.
