Course Outline: This simulation course approaches patent prosecution from a practical perspective, aiming to equip students with fundamental skills not only in claim drafting, but also in argumentation, advocacy, and collaboration with inventors, clients, and patent examiners. An overarching goal of this course is to help students to begin developing an identity as an intellectual property counselor—a practitioner whose mission is far broader than merely to secure patent protection.

Course Notes: (Synchronous Online) The UH registration system instruction mode for this course is listed in parenthesis. Contrary to the UH information, some student materials may not be available online, such as an assigned casebook. A physical classroom may be assigned for this course to give students a location in the Law Center to join the virtual class sessions. If the course has a final examination, the final and any other assessment for the course, such as a mid-term exam, will be conducted without the need to physically come to the Law Center, such as, for example, via the EBB portal as a take home exam or under remote proctoring.

Students should also note that participation in the course brings a special opportunity to obtain the most widely known and used commercial treatise in patent prosecution, Faber on Mechanics of Patent Claim Drafting (7th ed. 2018), at a special student rate that is approximately one-fourth of the cost that a law firm or practicing attorney would pay.
